When your claim reaches settlement or judgment

When your compensation claim reaches settlement or judgment, you or your compensation payer have to repay any amount owing.

With a valid Notice of past benefits

A Notice of past benefits is valid for 6 months. If yours is still valid on the date of judgment or settlement, the compensation payer must:

  • send us the amount to be repaid within 28 days
  • send the remaining amount of compensation to you.

The payer can’t pay your compensation until they’ve paid us.

Without a valid Notice of past benefits

If your Notice of past benefits has expired before the date of judgment or settlement, you or the compensation payer may either:
