What you need to do before your compensation claim settles or reaches judgment.

Step 1 — Complete your history statement and declaration

Complete the Medicare history and care services statement and Declaration that we’ve sent you. This is where you tell us which benefits relate to your injury or illness.

You’ll need to go through the statement and tick ‘yes’ or ‘no’ for each service, and complete the declaration. Only tick ‘yes’ next to services you believe are related to your injury or illness.

If you change your care services answers to ‘no’, you must attach a letter to the completed statement and Declaration.

The letter must:

  • be from a treating doctor or another expert medical practitioner
  • confirm the care costs weren’t related to your injury or illness.

We can’t process incomplete statements. If an incomplete statement is received, all services will be included. We don’t accept edits or additions to previously submitted statements.

You should check you’ve ticked ‘yes’ or ‘no’ against each item, answered all questions, and signed and dated the declaration.

Step 2 — Return the statement and declaration to us

Send the completed statement and declaration within 28 days to the address on the form.

If you need more than 28 days, call the Medicare compensation recovery team line.

If you don’t return the statement and declaration, all the services on your statement will be removed from your compensation payment.

Step 3 — Check your Notice of past benefits

We’ll send a Notice of past benefits to you and the compensation payer. This states how much you we will recover from you compensation. If you agree with the amount, this will become a Notice of charge.

The compensation payer will use the Notice of charge to pay us back first. Then they’ll pay the rest of the compensation money to you.
