Your compensation payer’s responsibility

When you make a compensation claim for an injury or illness, there are things the compensation payer must tell us.

When you claim compensation for an injury or illness, the payer must tell us if:

  • the compensation awarded is more than $5,000, including all costs
  • a reimbursement arrangement is made more than 6 months from the date of the claim.

To do this, the payer needs to complete a Medicare Compensation Recovery Notice of Judgment or settlement form. They have 28 days from the judgment or settlement date to send us this form.

They don’t need to tell us if:

  • your claim has settled for an amount less than $5,000, including all costs
  • within 6 months of making your compensation claim, you have a reimbursement arrangement for medical expenses
  • the illness or injury occurred overseas, where the claim is not settled under Australian law.
