If you disagree with a decision

We can’t change or review decisions by your super fund or the Australian Taxation Office (ATO) if they decide not to release your super early. You’ll need to contact them.

Your super fund will decide if you can access your super early. They’ll assess your application against the eligibility requirements in the Superannuation Industry (Supervision) Regulations 1994. Decisions aren’t made under the Social Security Act (SSA).

We can’t change or review decisions if your super fund or the ATO won’t release your super because of any of the following reasons:

  • you don’t get an eligible income support payment
  • you haven’t been getting a payment from us for long enough
  • you weren’t getting a payment on the date of your application
  • you don’t meet the legislative requirements
  • you’ve had gaps in your payments
  • you don’t meet their requirements.

If your super fund or the ATO won’t release your super early, you should contact them about the decision.
